Conditions of Use at 5 january 2008 12:10 (v1.3e)
1.Introduction.
The present Agreement is a legal document originally drafted in English which sets out your rights and obligations as well as those of Spootnic.com, a company registered in the Dutch West Indies (“Spootnic.com” or “we”), in relation to the present site and the services offered by Spootnic.com by means of the following (“Spootnic.com’s Service”). In applying for Spootnic.com’s Service, you accept the terms of the present Agreement and you renew your consent to the stated terms each time you use it. Furthermore, the use of certain Services implies that you accept particular conditions, a usage license or that you will comply with the Conditions of Use available on the pages pertaining to these Services. Unless inconsistent with the context or subject matter, these specific rules shall apply concurrently with the Conditions of Use. However, in case of inconsistency, the specific rules shall prevail. Visitors to Spootnic.com’s Service who don’t apply with a view to becoming Members (see Clause 2 below) acknowledge that they are bound by the present Agreement each time they access Spootnic.com’s Service. We don’t separately record the different Agreements to which Members may be subject. Each use or viewing of the Services provided by Spootnic.com, whether it be free, paying or require the creation of a Spootnic.com account, is permitted only on the basis that you agree to be bound by the current “Conditions of Use”. Please carefully read the Conditions of Use, print and keep a copy of them. We advise you to print also all games rules, your transaction data and everything relating to your payment on the site.
2.Spootnic.com’s Services
Spootnic.com provides its members with the opportunity to play games that we offer on the site and of participating in challenges and tournaments with other Members. Our games consist of exercises in pure dexterity and reflex control, the element of chance plays no part. As a result, when you participate in a tournament with other Members, it is your intelligence, your dexterity, your speed and your tactics which will enable you to win against them, and the victor will be the Member who, by putting into practice the aforementioned skills, has either earned the most points or finished the game the fastest. Before offering or accepting a Challenge or registering for a tournament, we recommend you carefully read the rules of the game and then practice the game.
Spootnic.com does not provide Internet access. In order to take advantage of our Services, you need to subscribe to a high speed Internet connection and know how to use one of the recommended Internet browsers. The charge incurred from such usage is your sole responsibility. Moreover, you need to provide all necessary equipment in order to secure this connection to the Internet. Ours are solely multiplayer on-line games, which means that you can only play against another user of the Service and never against a computerized system. This characteristic necessitates appropriate equipment and a continuous Internet connection. You are solely responsible for the compatibility and adequate speed of your Internet connection, as befits the service needs. (Refer to art. 14 for the minimum technical requirements). It is your responsibility to ensure that your equipment and your software will not disturb or interfere with the Spootnic.com Services. You must immediately disconnect any machine or software which would cause interference with the Services. It is advisable that you retain the stored or exchanged Contents of the Services on a back-up copy so as to protect against any risk of loss.
3.Registration and Membership
In order to find out about the games and to practice free of charge, you must apply to be a « Guest ». The status of “Guest” only permits partial access to the Services for a limited duration. To access the entirety of our Services, you need to apply as a Member to Spootnic.com’s Service and in so doing, open an “Account”. Registration as a “Guest” and Member, as well as the opening of an account, are entirely free of charge.
At the time of registration, you acknowledge that you are at least eighteen years of age and that you are perfectly legally able to participate in the games and tournaments we offer. It is incumbent upon you to verify that national or European Community laws, contracts or any other legal agreement by which you are bound does not interfere with or limit your right to participate.
The employees and their families, external contributors and other persons involved with Spootnic.com are authorised to participate in tournaments aimed at testing their skill, but can not withdraw money or prizes in their name.
4.Spootnic.com's policy on privacy
In registering with Spootnic.com’s Service, you are accepting our use of personal information, as set out below. Personal registration information provided upon the creation of an account with Spootnic.com, as well as the IP messages directly collected by Spootnic.com when you use its Services, are treated as strictly confidential. None of the personal information required for registration as a Member will ever be conveyed to another Member. It is incumbent upon you to safeguard personal information. Any deliberate disclosure on your part to discussion forums is your sole responsibility. Your personal information can only be conveyed to other participants in special cases where you give us express consent by opting for such disclosure, then clicking the “I accept” button. Spootnic.com has access to your personal information and makes use of it in five ways:
- in order to enable you to access Services and to respond to your questions concerning Service use.
- to personalize advertising material on offer,
- to enable you to be part of Spootnic.com’s promotional offers or to inform you of new services, subject to your approval,
- to optimize running and efficiency of Spootnic.com’s products and services.
Spootnic.com also collects contact information in order to adhere to current legislation and to protect you from fraud.
We use anonymous extracts from your personal information for our surveys and statistics, in order to monitor the Spootnic.com site. Spootnic.com also uses cookies and web markers.
Your personal details may be transferred to our technical and business partners, in order to process or store them. We guarantee you that the transfer of your personal details is subject to an agreement between Spootnic.com and the aforementioned partners, which guarantees protection of this information and that it can not be used for business purposes.
Because it is subject to professional confidentiality, Spootnic.com can only disclose personal information when a requisition is issued by a legal or administrative authority from the Dutch West Indies, or by means of authority from the State in which it is processed or stored. We guarantee that you have the right to consult, change and withdraw all personal details collected by Spootnic.com by contacting our Customer Support.
Spootnic.com can also use the IP address in order to identify Internet users who contravene the existing General Conditions of the Site or Services or who cause damage to Spootnic.com. In this circumstance, we are entitled to convey your connection details to the relevant authorities.
In the case of death, and upon production of written proof, the account will be deactivated. Its contents may only be conveyed to the deceased person’s legal personal representative.
5.Public Information
The following information is not considered personal or confidential:
Alias, nationality, scores, classification, records, amounts won over a period of less than a month. (The sum of your winnings or losses as well as the total amount of your purse is considered confidential).
In registering as a Member, you give your consent to the posting of all or part of this information on the site and to the viewing of it by other Guests and Members. Such information consists of the Alias you have chosen, as well as your tournament scores and records. The posting of this information on our site or on any other supporting communication in your country of residence or in another country does not give you the right to claim any rental charge, remuneration or compensation.
Spootnic.com will use electronic mail to confirm deposits and withdrawals from your account, to send you information about new games, promotional offers, various events and changes to our Conditions of Use. Important messages will be sent to the electronic address you have submitted for as long as your Account is open, but at any moment you can choose to receive or no longer receive promotional e-mails using the form provided for this purpose by clicking here or contacting the service client.
6.Accounts
Each individual has the right to open only a single account called « Start-up Account ». This account must only be used by the individual in question, and by no one else. Having closed, left inactive or stopped using his/her Account, a Member does not have the right to open a new one. If you have lost your user name or password, you need to contact Customer Service in order to generate a new password after verification of your identity.
Your Grading for each of the games attaches to your individual identity, as does your purse.
Use of Spootnic.com’s Services must be done solely by connecting to the Start-up Account opened by the Member. Spootnic.com has the right to control adherence to this requirement by verifying IP and postal addresses, bank account and credit card numbers and/or all other forms of payment used to credit an Account.
In cases where a Member has failed to adhere to this requirement, Spootnic.com has the right to close any Account except the lawful Start-up Account and to add the totality or a part of the funds from this/these Account/s to the Start-up Account. If such a situation arises, the maximum total amount transferred must not be greater than the sum total of the deposits, minus all withdrawals which will have been paid out of the additional Accounts in question. All winnings shall be confiscated. Furthermore, Spootnic.com will have the right to be compensated for the amount transferred, and will allocate a total amount equivalent to all the transaction costs accrued because of the misuse of the Accounts in question. Moreover, Spootnic.com reserves the right to close all offending accounts and to deny all subsequent access.
A Member does not have the right to use the same payment method to credit or debit different accounts. Spootnic.com reserves the right to refuse a deposit or withdrawal requested by a payment method already used to credit or debit another Spootnic.com account.
We will not be liable for any loss incurred by you if an unauthorized person has access to your Account, and we exclude all responsibility for its unauthorized use, whether or not it is fraudulent.
As is customary, it is your responsibility to keep the password for your Account strictly confidential.
By opening an Account, you accept that Spootnic.com has the right to access information pertaining to your Account in order to investigate any complaints and/or any other allegation of misuse.
Refund Policy
At any moment a Member can ask for all or any of the withdrawal amount available on his account to be paid to him. The amount that the Member can dispose of will be posted on the site in the column "My Account" and is calculated in the following way :
Accumulations of the payments - accumulation of the expenses of participation + accumulation of the earnings - accumulation of bonuses money - accumulation of the previous withdrawals.
The expenses of withdrawal apply to every cash withdrawal of the account and are fixed to 5€ whatever the amount of withdrawal is.
Spootnic.com reserves the right to refuse to process a withdrawal of money if it is requested by another payment method than that used to originally credit the account. In this situation, the Member must explain to Client Service why he wishes to use different methods for debiting and crediting the account. The expenses of withdrawals will be increased by the specific expenses in the method of payment required by the Member.
When an Account is closed, a sum equal to the maximum remaining funds eligible for withdrawal shall be returned to the Member. Deposits of funds to the Account, minus all withdrawals from the same Account, shall be credited to your designated credit card. Credits surplus to this amount, resulting from wins from Spootnic.com’s Service, shall be credited to your designated bank account.
In situations where we have sound reasons to suspect fraudulent use of an Account, we reserve the right to suspend crediting that Account with the eligible funds until the stop on withdrawals from that account no longer applies.
In situations where you have provided manifestly deceitful, inexact or incomplete information about your Account, Spootnic.com shall have the right to cancel your Account and confiscate all prizes due to you.
Bonus Money
Spootnic.com may present Guests and Members with promotional offers in the form of crediting their Accounts with a varying amount in Euros, called a “Bonus”. The total amount of Bonuses accrued enables Members to participate in Challenges and tournaments and win prizes. However, the Bonus can not be withdrawn from the account by the Member. In the situation where the balance of the Account is less than the total amount of the Bonus or Bonuses credited by Spootnic.com, the Member can continue to play, but can not make a withdrawal from the Account. When the balance of the Account is more than the total of the Bonuses provided, the cost of participating in Challenges and tournaments is firstly debited from the amount in excess of the Bonuses, then from the Bonuses themselves.
The bonus proposed for the opening of an Account are credited within 24H, however, the bonus is definitively acquired only after the third cash matchplay. In case of withdrawal request of the funds credited by the Member before the end of his third cash matchplay, the bonus will be cancelled.
7.Games, Winners and Prizes
Your dexterity, speed and/or adroitness as compared to those of your adversary will determine the results of a game. In order to enable Members to be matched against other Members of a more or less equal level, we have put a system of grading in place: “Grading”. This grading system is based on a relatively complex mathematical algorithm designed to keep you informed about your own level and that of other Members. Before each game it is your responsibility to verify that your potential adversary’s Grading is approximately equal to your own, so as to provide each of your opponents with a reasonable chance of winning. However, it is still up to the discretion of Members to offer or accept a Challenge or a tournament against an adversary with a very different Grading.
Spootnic.com does not guarantee that the grading system is perfect. Its only role is to provide information. Under no circumstances can Spootnic.com be held responsible if a Member’s dexterity, quick reflexes or adroitness turn out to be of a superior level to his Grading. Games played for “Training” purposes are not taken into account when Grading. It is especially important to understand that the competency of a Member who has practised intensively may not equate to his Grading. Spootnic.com reserves the right to change at any time and without preliminary notification, the method of calculating Gradings, as well as the individual Grading of a Member for a game or for all games.
Your Grading for each game will be adjusted after each match according to the result of the match. You can learn more about this subject by consulting the Grading rubric of the Question Forum. You must not do any thing that might corrupt our grading system. The calculation method is confidential and can not be divulged to a Member or questioned by him.
The prize amount for all of the challenges involving money, is available before each match under participation costs. You can obtain more information on the relationship between participation costs and the prize amount in the “Challenge” section, featuring questions and responses.
You can find the rules, the way to score points and the instructions for each game on offer by Spootnic.com in the section pertaining to specific Assistance for the game in question. The cost of participation is automatically deducted from your Account before the start of the match from the moment you click the button, “I accept”. This button appears beside the summary of game details, consisting of: the Alias of your adversary, the game he is proposing, his Grading, the cost of participation and potential winnings for the victor. From the moment you click the “I Accept” button, you can not reverse any action or cancel your participation. The cost levied is based on each entire match. Interruption in the middle of a match does not give you the right to even a partial re-imbursement of the participation cost (subject to the exceptions provided in article 12d).
At the end of each match, the players are informed of the result, the winner and the amount won. It is essential that you don’t disconnect or close your Internet browser before these results are posted.
The account of the winner is credited with the amount of the earnings and is at useful to play again or to be removed in the conditions of the article 6.
Regardless of whether you are winning or losing, disconnection, at any moment during or after the end of the match before the results are posted, will be interpreted as abandoning the match by the system.
In any case, if you have won the match and you do not notice the credit on your account, you have to get contact with the Customer service shortly.
After a period of 30 days, no more complaint as regards to the result of a match or the credit of a gain will be taken into account.
If you have good reason to believe that your adversary has employed any fraudulent method to win or that his Grading is manifestly below his capacity for dexterity, speed or adroitness, you need to inform Client Service as quickly as possible at the web address Contact us. If, after our Service has investigated, we find that your adversary has used fraudulent methods either to win or to lessen his Grading, we will reimburse your participation cost. Under no circumstances can the cost and/or the winnings specified at the beginning of the match be awarded to you.
Any amount credited by mistake to your Account, becomes our property and will be automatically transferred from your Account as soon as the error is discovered. If you have withdrawn part or all of this amount, it shall constitute a debt for which you will be liable to Spootnic.com.
8.Legality
Spootnic.com reserves the right to track the place from which you appear to have access to Spootnic.com’s Service and, when requested to do so by a reliable authority, to use certain measures to forbid access pursuant to territorial jurisdiction forbidding or limiting access to Spootnic.com’s Service from certain localities. Consequently, Spootnic.com is within its rights to require that a winning Member produce evidence that he or she is allowed to participate. You undertake to respect the laws pertaining to you in the State from which you are accessing Spootnic.com’s Service. If the laws pertaining to you, limit or forbid your participation in Spootnic.com’s Service, you must respect these legal limitations.
9.Functioning of Spootnic.com’s Services
We have the right to withdraw or change one or several games or aspects of Spootnic.com’s Service when we have legal or technical reasons to do so, including (a) objections concerning privacy, safeguarding of information and other objections relating to the contents or conduct of Spootnic.com’s Service, and (b) technical difficulties encountered by Spootnic.com or on the Internet. Spootnic.com’s Service may also be unavailable due to either foreseen or unforeseen circumstances. For security or other reasons, we may ask you to change your Password or other information facilitating access to Spootnic.com’s Services.
10.Abuse of Spootnic.com’s Services
Members can use Spootnic.com’s Services only within the scope and rules dictated by Spootnic.com. They must not use unfair methods aimed at gaining advantage over other Members or subverting a Spootnic.com Service from its original purpose. Any technique enabling a Member to alter his performance skill is judged unfair. These techniques include, but are not limited to, the use of computer programs or commands or any computer hardware or software designed to assist the Member in the game or to usurp the identity of another Member.
The following are deemed unfair : all practices aimed at disrupting equality between Members, intentionally losing games in order to gain a competitive advantage, opening or using several Accounts, to collude with other Members in order to win or lose. In addition, Members must under no circumstances do any thing that could give rise to a disruption or malfunctioning of Spootnic.com. Unfair behaviour may be detected despite a Member’s success.
The use of discussion services, (« CHAT ») implies automatic adherence to rules of proper conduct and respect for other Members. We forbid any content of a sexual, religious or political nature, or that which would be contrary to the legislation in effect in the Members’ States. Since we do not have the technical means to verify that each discussion complies with these rules, we ask you to notify us of any offensive content.
Through use of our Services, we forbid you to engage in activities of any nature which would contravene the laws of the State in which you reside or which would undermine the public order of that State or the rights of a third party. In particular, but not limited to, you are forbidden from:
- engaging in acts which vindicate crimes against humanity, negation of genocides, incitement to violence, racial hatred or child pornography
- engaging in acts of defamation, abuse, threat, blackmail, harassment or in acts detrimental to privacy or human dignity
in particular, but not limited to, transmitting, diffusing, editing, publishing or rendering accessible any content which could be deemed incitement to crime and offence, dissemination of false information or financial details subject to confidentiality or any matter designed to market or sell objects and/or works, software, material forbidden by law or which may affect the following: third parties, the authority of the justice system, privacy, the safeguarding of personal information or the confidentiality of communications, the divulging of information covered by the oath of secrecy or the right to privacy, notably: plenary adoption, a trial in session, suicide or the health of a third party, an inheritance or individual financial matter, or any act putting minors in danger, notably by the fabrication, transmission, diffusion or accessibility to messages of a violent or pornographic nature, of a nature which would undermine human dignity or enable the fabrication of explosives
attempting to mislead other users by usurping their identity or social denomination or by undermining the image or reputation of others and/or pretending to be a third party, employee, a service expert or an affiliate of Spootnic.com, falsifying personal information, messages or documents, headings of messages, identification details or Service connection or manipulating identifying information in any other way so as to disguise the origin of the material transmitted via the Service
- engaging in a violation of intellectual property rights (notably vis-a-vis music, video, animation, games, software, personal data bases, images, sounds and written documents) or any other right of ownership (hereafter collectively designated the “Rights”) belonging to another
- exhibiting, transmitting, diffusing, conveying or rendering accessible in any other way any material including or consisting of computer viruses or any other code or computer program invented in order to interrupt, destroy, divert or limit the functioning or performance of any software, computer, service or electronic communication tool
- disturbing, slowing down, blocking or altering the normal flow of information exchanged by means of the Service, accelerating the rate of presentation of the Service’s Contents in such a way as to modify or change the functioning of the Service or committing any other action having an equally disruptive effect on the functioning of the Service
- fraudulently accessing, hindering or disrupting Spootnic.com’s computer system and especially, the Services, the servers, the networks connected to the Service, or refusing to conform to required conditions, procedures, general rules or legal agreements applicable to networks connected to the Service.
Signaling of Abuse
If you deduce or believe that discussions are of a patently illicit nature, you can convey this to Spootnic.com by completing the form available in Contact Us at the bottom of each Spootnic.com page, chosing the subject Report and abuse and supplying message text containing:
- your username WITHOUT the password
- Alias of the implicated member/s
- precise time and place in the site where the illicit material is kept
- the reasons why you think the discussion was illicit
We guarantee you that your name will not be disclosed to the incriminated person. Therefore, you shall be subject to civil and/or criminal sanctions if the reason for your notification of an illicit discussion is to ensure that your own involvement is exempted.
Your notification should enable Spootnic.com to identify the discussion.
The Fight Against Abuse
In reference to the fight against illicit content, and especially against child pornography, Spootnic.com will be able to freely access discussions on the on-line public communication services.
As soon as Spootnic.com becomes aware of an illicit discussion occuring on its Services, an investigation will be conducted aimed at promptly blocking the discussion if it is still in progress, and blocking the participants from accessing the site. Spootnic.com will be free to notify or not, the persons responsible, without bearing on the cancellation of the offender’s account, pursuant to article 11. In the aforementioned circumstance, Spoonic.com must notify or bring to the attention of the relevant public authorities the need to act on the illicit activities.
To clarify matters, Spootnic.com bears no general legal obligation to survey discussions on line, nor is Spootnic.com legally bound to block a discussion which does not appear to be manifestly illicit.
SPECIAL RECOMMENDATION TO INTERNATIONAL USERS
If you use a Spootnic.com service in a language other than English, the conditions of use pertaining to this service as set out in the foreign language are applicable.
11.Interruption and Cancellation Due to Violation.
We reserve the right (a) to interrupt or cancel any Member’s right of access to Spootnic.com or to a part of it and (b) to withdraw all prizes from one or several accounts if the suspect information, in our opinion, represents a contravention of the present Terms and Conditions. Any person whose access has been interrupted or cancelled must not attempt to reregister with Spootnic.com’s Services or cannot access it again without our preliminary consent. You are responsible for any thing done on or by means of Spootnic.com.
12.Conclusion.
Spootnic.com’s Service is intended for use by its members for the purposes set out in Clause 2 below. As a consequence, Members must not: - use Spootnic.com’s Services for other purposes,- to telecharge information on Spootnic.com or otherwise use it for other commercial or advertising purposes, or – to make use of access to Spootnic.com’s Service or information gathered from this Service in order to send unsolicited electronic mail (“spam”).
13.Intellectual Property
You acknowledge that all rights to authorship, trademarks and other intellectual property rights linked to and/or pertaining to Spootnic.com’s Service, with the exception of information introduced by Members, are the property of Spootnic.com. The users of Spootnic.com’s Services are not authorised to copy, distribute, show to the general public or create works derived from Spootnic.com’s Service or from any information found on Spootnic.com’s Service without preliminary written authorization from Spootnic.com.
14.Minimum Technical Requirements
In order to use Spootnic.com’s Services under the best possible conditions, you need to acquire at least the following equipment:
- High speed internet access (cable or adsl or any other access ensuring a speed equal or superior to 1Mb/s. You need to verify with your internet access provider that your speed is sufficient
- an internet browser – type Microsoft Internet Explorer 6.0 or above, FireFox 2.0 or above, Opera 9 or above
- a computer equipped with a microprocessor – pentium or superior, an active memory equal or superior to 1 gb or above, a mouse and a keyboard.
15.Responsibility
- Exemption from responsibility and liability
Spootnic.com has no control over and bears no responsibility for the truthfulness or the accuracy of information available on its Service and provided by its Members or third parties.
- If the sites belonging to third parties include a link to Spootnic.com’s Service, this does not indicate that we accept or assume any responsibility whatsoever in relation to this site or any of its contents.
- In relation to your judgment concerning what you see on Spootnic.com’s Service, you need to exercise the same degree of caution as you would if you were not on line.
- Despite the fact that it is forbidden, people can provide information or behave in an untrustworthy, deceptive or even illicit manner.
- Furthermore, be aware that people may not be who they seem to be.
- You use Spootnic.com’s Service at your own risk.
- Consequently, in accordance with the law, you absolve Spootnic.com, its administrators, contractors and employees of all responsibility emanating from or connected with Spootnic.com’s Service and to the information from Members and third parties found therein.
- Excluded Damages
Spootnic.com denies all responsibility towards its service users or towards all third parties for all losses or indirect or incidental damage or all loss of information, profits, revenue or contracts, whatever the cause (whether the result of negligence, a violation of these Conditions of Use or otherwise). Moreover, Spootnic.com denies responsibility for its failure to execute any obligation incumbent upon it by virtue of these Conditions of Use, as a result of factors outside its control.
- Maximum Responsibility
Without limiting the scope of the preceding Clause, over the course of any twelve month period, Spootnic.com’s total responsibility, as set out in the present Conditions of Use, (whether this responsibility ensues from negligence, a violation of contractual agreement or another reason),shall under no circumstances exceed the total amount in the account at the time of the acceptance of that responsibility. Notably, Spootnic.com can under no circumstances and at no time be held responsible for a Member’s pecuniary losses, whether or not those losses are the result of a violation of the present Conditions of Use of the site. It is each Member’s responsibility to supervise their own conditions and adversaries and in the aforementioned case to inform Client Service of other Members involved in fraudulent activities.
- Included Responsibilities
In the case where (a)as a consequence of the technical failure of Spootnic.com’s Service, a match can not be finished and (b) if we determine definitively that the responsibility for this failure lies totally with us, then, after examining the reasons for malfunctioning, Spootnic.com will reimburse the participants for the interrupted match. We deny all responsibility linked to payment of amounts which could have been won if the match were finished.
- Indemnification
You are charged with indemnifying us for the totality of responsibilities, demands and expenses incurred from any violation of the present Conditions of Use, in which you are involved or in which a machine used by you to access Spootnic.com’s Service is implicated.
16.Assignment
We reserve the right to forgo the present Conditions of Use or to waiver one or all of the rights and obligations pertaining to us under these Conditions of Use. You can not forgo or make use of this Agreement without Spootnic.com’s written consent.
17.Entirety of the Agreement
The present Agreement sets out the integral nature of the relationship between you and us at Spootnic.com’s Service and this Agreement replaces the collection of agreements and previously suitable codes of conduct, with the exception of any fraud or fraudulent declaration for which one or other of us is responsible.
18.Changes made to the present Convention.
Spootnic.com reserves the right to change the present Agreement at any given moment and to send a new version of this Agreement to Spootnic.com’s Service. With each new version, a message will be delivered to you via the “Spootnic Broadcast” at the time of your first connection after posting of the new Agreement. You will then be invited to become familiar with the new version of the Agreement. It is your responsibility to read the modified Agreement carefully, because it will take effect immediately and will govern the entirety of Spootnic.com’s Services and the relationship that you maintain with Spootnic.com.
If any one of the changes concerns an arrangement currently in force from the present Agreement and likely to negatively affect you or if you do not wish to be governed by the new version of the Agreement, you can inform us at or before the date upon which the new version of the Agreement is to take effect. You must cease use of Spootnic.com’s Service starting from that date.
19.Divisibility.
In the case where a term of the present Agreement is deemed null and void or inapplicable by a judgment or legal decision, the remaining terms of the present Agreement shall still be valid and applicable.
